You remain sacked – A’ Court tells Kano gov, Kabir Yusuf

The Court of Appeal sitting in Kano has. restated that its judgement upturning the election of Kabir Yusuf, as Governor of Kano State.

 

The clarification is coming on the heels of the controversy trailing the certified true copies (CTCs) of the judgment, which state that the appellate court had affirmed Yusuf’s election while upturning the ruling of the election petitions tribunal, which had sacked him.

 

The Chief Registrar, Court of Appeal, Umar Mohammed Bangari, insisted that its judgment on the dispute over the last governorship election in Kano State remains as pronounced in the open court.

The appellate court reiterated that it dismissed the appeal by. Yusuf and the New Nigeria Peoples Party (NNPP) as earlier decided by the election petition tribunal.

 

Bangari noted that there was nothing to the controversies generated by the noticeable typographical errors in the CTC of the judgement.

 

He added that what errors observed in the body of the judgment were due to clerical error and did not invalidate or alter the findings and conclusion of the court, adding, however, that the errors would be rectified.

 

The Chief Registrar cited Order 23 Rule 4 of the Court of Appeal Handbook, which empowers it to correct any clerical error once detected by the court or concerned parties in a case.

According to him: “What happened in the part of the judgment being complained about is just a mere clerical error that ought not to draw any issue.

 

“The court is empowered to correct such clerical error and would be done as appropriate.”

 

The appellate court had stirred controversy with the errors observed in the CTC of judgment, resulting in NNPP claiming that the judgement had vindicated Yusuf.
