Atiku Abubakar, the presidential candidate of the People’s Democratic Party (PDP), in February 2023’s disputed presidential election, is unrelenting in his quest to quash the declaration of Bola Tinubu as winner.
Therefore, he has approached the Supreme Court, seeking for approval to submit some of President Tinubu’s academic records as obtained from Chicago State University, CSU, as fresh evidence to support his appeal in the apex court.
The application is based on Order 2, Rule 12(1) of the Supreme Court Rules 1985 and section 137(1) of Nigerian constitution.

Chris Uche, SAN, Atiku’s lead counsel, filed the application on October 5, urging the Supreme Court to grant him leave to file fresh and additional evidence, including a deposition on oath of an official of the CSU, regarding Tinubu’s academic documents.
The former vice president had questioned the authenticity of the CSU certificate that Tinubu submitted to the Independent National Electoral Commission, INEC, as a candidate for the 2023 presidential election.
He contended that the certificate was forged and that Tinubu was not qualified to participate in the election.
However, the Presidential Election Petition Court in Abuja, dismissed the certificate forgery allegation and affirmed Tinubu’s election.
Atiku appealed against the decision at the Supreme Court and even proceeded to obtain an order of a United States court, which compelled CSU to release Tinubu’s academic documents, which he now wants the apex court’s permission to file as fresh evidence.
